Easements

 

Many properties may have easements registered on their title. Some easements may be due to Council infrastructure, however many can also be due to the presence of other service utilities assets.

 

Council does NOT have a record of easements on properties, and we are NOT able to assist you in determining whether there is an easement on your property.

In the instance you suspect you may have an easement on your property you should check your Certificate of Title. If you don't have a copy of your properties Certificate of Title then they can be obtained from the Lands Titles Office (LTO):

As a guide, references to easements on your title can usually be attributed to the following services:

 

1) To Council for drainage purposes                     - typically for stormwater

2) To Council                                                     - typically for CWMS or stormwater

3) To SA Water                                                  - typically for Water supply mains or sewer

4) To Minister of Infrastructure                             - typically for gas or electricity supply

 

Council CAN assist you in determining the nature of an easement (be it stormwater or CWMS) if you have found one on your title.

 

Note that creeks and watercourses are NOT controlled or maintained by Council and if one exists in your property then you will not have an easement.
